Man Who Couldn't Stand Up Gets Fifth DWI

Sean M. Herod had been convicted in 2006 of two DWIs within three days of each other.

A 32-year-old man faces his fifth charge of driving while intoxicated after he could not complete a sobriety test because he could not stand up, according to a St. Charles County Sheriff’s Department report.

Sean M. Herod, 32, of the 10100 block of Schultz in Foristell, was charged with DWI as a chronic offender, a class B felony.

Nine days after Herod successfully completed probation for two DWI convictions in 2006, St. Charles County Sheriff’s deputy pulled Herod over for driving erratically on Highway 94 near Westwood Drive just east of Weldon Spring.

The deputy tried to administer a sobriety test, but said Herod could not complete it “due to an inability to stand up.”

Herod refused a Breathalyzer test and officials obtained a search warrant for a blood sample, according to court documents.

Herod’s 2006 convictions were for two DWI incidents just three days apart on June 14 and June 17, 2005. His probation had been revoked and he was given 120 days shock jail time in 2008, and he was placed on five years probation again in 2008.

Herod also has DWI convictions in 2004 and 2000.

Bail was set at $25,000. Herod posted the bond Thursday.
